Transfer of Claim

This module covers the method for filing a Transfer of Claim. This event is available for both attorney filers and LFU filers.

        STEP 1     From the Main Menu, select Bankruptcy. (See Figure 1.)

        STEP 2      On the Bankruptcy events list select Claims Actions. (See Figure 2.)

When the Case Number prompt appears, enter case number.

  • Enter the correct case number.
  • Click on the Next button to continure.

 

        STEP 3      The Claim Actions Menu is displayed. (See Figure 3.)

  • Since it is already visible, click on Transfer of Claim event in the list.
  • Click on the Next button to continue


        STEP 4      The Joint Filing screen is displayed. (See Figure 4.)

  • We will leave the box unchecked.
  • Click on the Next button to continue,

 

STEP 5      The Select the Party screen is displayed. (See Figure 5.)

  • This list is of the parties who have filed actual electronic actions in this case.
  • If you have filed a previous pleading in this case as a Limited Filing User, your name would appear in this list and you would select your name.
     
  • If you had not filed a pleading in this case, add yourself as a party to this case. Once added, you would select yourself in the Party List, click on the Add/Create New Party hyperlink to add yourself as a party to the case.

    See the Create New Party Process routine for details.
Note: Your search in the Create New Party Process should find yourself listed in the system database. You are added to this database when you get your login. If you fail to find yourself, something is wrong and you would need to contact the Court for resolution..

 

Note: When you complete the Party Information screen in the Create process, select Creditor in the Role field.
  • Once your name (the transferee filing the Transfer) appears in the list, select it.
    - Aaron Rents for this example.
  • Click on the [Next] button to continue. 

 

        STEP 6      The Select the pdf document creen is displayed. (See Figure 6.)

  • Browse to the pdf file containing your Transfer of Claim
  • If you have additional pdf files, attach them.
  •  See the Browse Process to identify the pdf file containing your Transfer of Claim pleading.
  • Click on the Next button to continue.

 

STEP 7      First a information message is displayed notifying of the next screen. (See Figure 7.)
Then the "Is there a claim number for this entry" screen is displayed. (See Figure 7a.)

  • Read the message and then click on the Next button to continue.

  • Select "Yes" or "No" as is appropriate for this question.
  • If you selected "Yes", go to next Step. If "No", skip to Step 10.
  • Click on the Next button to continue.

 

  STEP 8      If you had entered a "Yes" on previous step, then the Enter Claim Number(s) screen is displayed. (See Figure 8.) If "No", skip to Step 10.

  • Since we said "Yes" on previous screen, we are prompted for claim number.
    Enter the number of the claim to be transferred.
  • Click the Next button to continue.

 

  STEP 9      The Designate Claim Status screen is displayed. (See Figure 9.)

  • Here we select the Transfer - See Docket # entry.
  • Click the Next button to continue.

 

  STEP 10     The Transfer Claim Data screen is displayed. (See Figure 10.)

  • Click in the appropriate Transfer Type per Bankruptcy Rules.
  • If you know the creditor receiving the claim is not on the case, use the Add New Creditor button to search the master database for the creditor and then adding them to this case so they will appear in the creditor list generated when the Search Creditors button is clicked - see below.
     
  • Enter the first few letters of the creditor receiving the claim as a "search clue", and/or click on the Search Creditors button to search for creditors currently on the case. A system popup window is displayed. If no search clue is entered, the system will make available all creditors. (See Figure 10a.)

  • Here we see the search results as a pop-up window where no clues were entered.
  • If you had entered a search clue, the list would only show creditors on the case that meet those clues.
  • Scroll down until the creditor who will receive the claim is shown. Then click on their name.
  • Click on the Select button to select that creditor. That creditor will then appear in the Transferee selected field when you click next as seen in Figure 10b - Aaron Rents - Pittsburgh for this example.
  •  Click on the Next button to continue.

  • Now enter or search for the creditor who is transferring (transferor) the claim.
  • As we did with transferee, select the creditor if they are on the case already or add them to the case and then select them.
    They will then appear in the Transferor selected field as seen in Figure 10d - Aaron Rents in this example.

Start this process by clicking on the Search Creditor button to see the list of the currents
creditors on the case. Get slightly different search results display. (Figure 10c.)

Note: Those creditors on the case who have filed claims display the claim number for that claim.
  • Click on the current owner of the claim to be transferred.
  • Click on the Select button to continue.

  • If there were other claims to be trasnfered to this Transferee, you could use the
    remaining Transferor boxes on this screen.
  • Once completed, click on the Next button to continue.

 

  STEP 11     The Modify Docket Text screen is displayed. (See Figure 11.)

  • Verify the creditor names and claim number. Return to previous screen to make any corrections.
     
  •  Click on the Next button to continue.
     

  STEP 12     The Final Docket Text screen is displayed. (See Figure 12.)

  • Verify the docket entry. Return to previous screen(s) to correct any errors.
     
  •  Click on the Next button to upload the pdf file containing the Transfer.

 

            STEP 13     The Notice of Electronic Filing is displayed. (See Figure 13.)

  • The screen verifies that the Transfer of Claim has been uploaded and filed.
     
  • To print a copy of this notice, click the browser [Print] button or icon.
     
  • To save a copy of this receipt, click [File] on the browser menu bar and select Save Frame As.

 

Use your Browser's BACK button to return to the previous screen.
