Withdrawal of Claim

 

STEP 1 Click the Bankruptcy hyperlink on the CM/ECF main menu bar.

  • Click on Claim Actions.

 

STEP 3 The Claim Action screen displays. (See Figure 3.)

  • Click on Withdrawal of Claim.
  •  Click the [Next] button to continue.

When the Joint filing with other attorney(s) screen appears, click on the box if appropriate.

  • Click the [Next] button to continue.

STEP 4 The Select the Party screen will display.

  • If you have filed a pleading in this case as an attorney, your client's name would appear in this list and you would select your client.

    Note: Any creditors seen in the Party list are there because they filed an actual electronic filing on the case. Filing a claim or being in the mailing matrix does not automatically put a creditor on this list.

  • If you had not filed a previous pleading in this case, you would add your client as a party to this case. Once added, you would select your client in the Party List.
    ( Click on the Add/Create New Party hyperlink to add your client as a party to the case.)

    See the Create New Party Process routine for details.

    Note:     When on the Party Information screen in the Create process, select "Creditor" in the Role field.
     
  • Once your client appears in the Party List and is highlighted, click on the [Next] button to continue. 

 

Note: If you had to add your client, or if your client was on the Party list due to a filing completed by another attorney, you will get the attorney/party association screen. Definitely click in the box to establish the association.

STEP 5 The Select the pdf document screen will then display.

  •  See the Browse Process to identify the pdf file containing your Withdrawal of Claim.
     
  •  Click on the Next button to continue.


 

STEP 6 Text stating that the next screen will ask for the claim number to be withdrawn. (See Figure 6.)

  •  Click on the Next button to continue.

 

STEP 7      The Enter claim numberscreen is displayed. (See Figure 7.)

  •  Complete the Enter the Claim Number(s) field.
     
  •  Click on the Next button to continue.


 

  STEP 8      The Enter Claim Status screen is displayed. (See Figure 8.)

  •   Select Withdraw as the Status from the drop-down list.
     
  •  Click on the Next button to continue.

 

 

STEP 9      The Modify Docket Text screen is displayed. (See Figure 9.)

  •  Verify the information displayed. Return to previous screen to make any corrections.
     
  •  Enhance docket with the claimant and amount of claim; could include claim number too.
     
  •  Click on the Next button to continue.

     

  STEP 10     The Final Docket Text screen is displayed. (See Figure 10.)

  •  Verify that the docket text is correct. If errors, use your Browser's BACK button to return to appropriate screen and correct.

    Note:    If you do make a correction, you must resubmit that screen and any subsequent screens. Do not use the Forward button.
     
  •  Click on the Next button to upload the pdf and file this pleading.
     

 

            STEP 11     The Notice of Electronic Filing (NEF) is displayed. (See Figure 11.)

  • The screen verifies that the Withdrawal of Claim has been uploaded and filed.
     
  • To print a copy of this notice, click the browser's [Print] button or icon.
     

 

Use your Browser's BACK button to return to the previous screen.
